How it works

There is no fee to speak to us about your case. We are happy to discuss what happened to you and determine if it is a case we can take. There is no up-front cost to retain Kragten Law. If you do decide to officially retain the firm, there is no obligation to sue. Insurance companies often settle without going to court. Everything will be spelled out for you from the start, so there will be no surprise fees or unexpected expenses. What you pay Kragten Law will be contingent* on the outcome of your case. The benefit of working this way is that it aligns the firm’s goals with your goals. There is no incentive for the firm to accept less than you deserve. Insurance companies often make low-ball offers early on in an attempt to get you to go away. We do not rush cases or take the easy route for a cheap recovery. The decision to accept or reject an offer is yours. We will always consult with you before settling your case. The award amount Kragten Law can get for you is typically far greater than what you could get on your own and more than enough to cover attorney’s fees*.

*Contingent attorneys’ fees refers only to those fees charged by attorneys for their legal services. Such fees are not permitted in all types of cases. Court costs and other additional expenses of legal action usually must be paid by the client.

Getting Started

Initial interview

The first step of the process is the initial interview. It’s important to capture as much detailed information as possible about the accident while it’s still fresh in your mind. Kragten Law will also advise you about how to proceed so as not to potentially compromise your case. They may collect statements from others at the scene, police body cam footage, and other items needed to put together the strongest case possible.

Collecting medical records

Another important element of the case is the record of your medical bills and treatment. Kragten Law will review your medical records containing every date and diagnosis code, what you were charged, and how much you paid. They’ll also comb through your medical provider’s comments on your condition and the plan for treatment. This is where Kragten Law’s background in medical practice is extremely important as these records can be complicated and confusing. Having an expert who understands how the medical and legal aspects of the case work is invaluable.

Demand Letter

With all of the information gathered, Kragten Law will distill everything into a Demand Letter that lays out the facts in the most powerful way possible and demands compensation. At every point in the case, Kragten Law will consult with you to make sure you’re in agreement with any demands and aware of any counter offers. And you will always be in control and make the final decision regarding whether or not to accept an offer and settle your case.

How long does the process take?

Every case is different, but it’s a good bet that it will take longer than you anticipate to reach an agreement. Kragten Law’s goal is to get you the best award possible no matter how long it takes. Sometimes it can be a waiting game where patience is to your advantage. Kragten Law makes no settlement decisions without your explicit approval. You are always in control of whether or not to settle. Kragten Law will keep you informed of any movement in your case and discuss how to proceed with you.

Settlement or Trial

Most cases can be resolved through settlement.  If we are unable to reach an acceptable settlement, the next step is to file a lawsuit.  In some cases, filing a lawsuit early is the better course of action.
